Now, the New England Patriots have joined the party as well. The company that is in question here is Hakuna Matata. The company has been selling cryptocurrencies under the brand name TATA. 

The Court admitted that it cannot be the case that the complainant is unaware of the original TATA company. TATA is an established global brand with a widespread presence in the Indian subcontinent. Given the Pakistani links of people behind this currency, it cannot be possible that they were unaware about it.

The respondents didn’t even try to hide the duplicity. The explicit display of the mark does point towards something unscrupulous. It is imperative that the motivation behind the people naming the currency TATA is not pure.

The court however, denied the plea to suspend the domain HakunaMatata.Finance. The court pointed out that just because it contains the term TATA, it cannot be infringing upon the complainant trademarks. The domain name doesn’t intend to dupe the complainant’s mark and the presence of complainant marks here can be considered a coincidence, hence cant be suspended.

However, the internet didn’t receive the campaign very well. Many accused Mercedes of being one of the chief contributors to the pollution. Claiming such a brand campaign was met with accusations of ‘Greenwashing’.

WhereFrom_UK, they posted a series of pictures. These pictures included various adverse effects of climate changes, and showed Mercedes’ logo on them, just the way Mercedes did in their Nature or Nothing campaign. WhereFrom even put the cherry on the cake,  with undersigning the images with Nothing or Nature mark. The opposite of Mercedes campaign name. 

The images showed Oil Spills, Lands drying and cracking up and Melting Glaciers with Mercedes logo. Interestingly the last image of lightning bolt has been kept the same as the original campaign. You can check the post here.

This witty reply has left Mercedes dumbfounded. There hasn’t been any official reply to this. However it has been heard that the brand campaign won’t be pushed globally.

This might be a major hindrance towards the name change of Wildberries. Without the domain name, rebranding can be a disaster. Wildberries experimentally changed their name for one day. It was changed back to the erstwhile name, after a day.

The Bank recently has acquired the domain name WestPac.com, reported itnews. Erstwhile the bank had been working on the domain name WestPac.com.au. Post the acquisition of the .com name also, the customer facing domain is still WestPac.com.au. WestPac.com redirects to WestPac.com.au.

Interestingly, the bank had started its operation with a different name. At its inception in 1817, it was known as the Bank of New South Wales. It was the name of the bank until 1982, when it acquired the Commercial Bank of Australia. Post the acquisition it acquired the name Westpac. The term ‘Westpac’ is an amalgamation of Western and Pacific.

The domain name earlier, had been with a Korean Electronics company. Westpac Associates had the domain name with them since 1998. The price of the acquisition by the Westpac Banking Corporation hasn’t been announced yet.

In a tweet ENS.eth announced the achievement over the important milestone. The name system continued its thundering growth in August also. At the end of July, the total number of .eth domains had reached 1.8 million.

In a matter of a few days, the number has exceeded 2 million. This shows the strong growth that Crypto domains are witnessing currently. As mentioned in the tweet, it took ENS 5 years to reach 1 million. However, the next million was reached in just 3.5 months!

A trademark dispute arose between Shivam Hardware Store and MS CENTURY WORLD (CW). The respondent Shivam Hardware Store had applied for a figurative mark that contained the terms ‘SHIVAM CENTURY’ in white fonts over a blue background, with SHIVAM written prominently. However, the Plaintiff CENTURY WORLD applied for an injunction against this application.

CW had registered the figurative mark of ‘CP CENTURY’ and ‘CWPL CENTURY’. In both of these marks CENTURY can be clearly seen with it being the prominent term. The words are written in black and white on a red background in the shape of an oval. CENTURY is written in white while CP and CWPL are written in black.

CW argued that the defendant had infringed on its trademark by adopting it in their own filed application. The plaintiff stated that the rights over the terms were not just limited to trademarks but enhanced through the continuous usage of the mark over a long period of time.

The defendant presented that CENTURY was a generic term. Thus trademark rights couldn’t be strictly applied here. The defendant also stated that the appearance of both the marks was different from each other and a confusion between the two was highly unlikely.

The court found that there were indeed similar terms between the two marks. The Court however could not find enough evidence to the defendant’s claim that the mark involved was generic and used frequently. The defendant also failed to provide bona fide usage of the trademark.  The Court in this light awarded the defendant with an injunction and restrained it from using the mark in future.

The case then went to the Delhi High Court. The Court found that although the CENTURY mark was used in a smaller font in the defendant’s mark, it could still lead to confusion. People can be easily misled into believing that both of the products are inter related. The Court thus cancelled the appeal.

Few days ago, the company had signed the pre-registration undertaking with Canada’s Ontario Securities Commission. With the agreement Crypto.com has become the first company to have such regulatory and legal rights for cryptocurrency related activities in Canada. So, is this just an expansionist move from the Company or is there something deeper here?

Before Canada and the UK, Crypto.com had signed agreements in South Korea and Cayman Islands. The reason behind these regulatory approvals is Crypto.com strategy for a visionary branding move.

Crypto.com wants to present itself as the safety bridge connecting the state governments and the Crypto world. The decentralised web was made on the principle that it’d be free from any central control. Without any surprise all the different governments saw the dWeb with suspicion and alarm. There was a wide gap in communication as innovative Crypto companies vied for a more elaborate decentralisation. 

Crypto.com wants to brand itself as the filler of these gaps. By signing one agreement after another it seems to champion a global approval for itself. Crypto.com, domain name is the perfect name to achieve such mass acceptance.

Crypto.com in short would be looking to be somewhat of a counterpart to Google.com in the Crypto world. As the company sees it, the gates of that world opens at Government offices of different nations.

The municipality of the town adopted a new domain name. The town had been until now using a .org domain name, i.e, BerlinAL.org. The county would now function on the new .gov domain, BerlinAL.gov.

This is another government entity opting for a more secure .gov domain name. However, the reason behind the move is not just the security concern. There are economic factors as well.

Few months ago the U.S. Cybersecurity and Infrastructure Security Agency (CISA) announced the wavering of .gov registration fees for the municipalities. Thus, opting for a .gov domain name has been economically viable and a more prominent option.

Radix has reported $3.8 million in Premium Retail Revenue in H1 2022.  This is a growth of 28.37% as compared to the previous Half. In H2 2021, Radix had posted a Premium Retail Revenue of $2.98 million.

Among the total retail revenue, $2.5 million came from Premium Retail Renewal Revenue. Retail Revenue Renewal grew faster than net Revenue at 38%. It amounted to $1.81 million in H2 2021.

Among the TLDs, .tech was the most profitable one for the company. The extension gathered a revenue of  $390,975. With a share of 41%, GoDaddy emerged as the most important registrar for Radix.

Federal Circuit Court witnessed an ongoing dispute between Philanthropist.com and General Conference Corp. of Seventh-Day Adventists (Seventh-Day Adventists Church, SDAC). Philanthropist.com’s owner had registered the domain Adventist.com in 2016. However the trademark ADVENTIST belonged to SDAC through a USPTO mark registered in 1986. The website used by SDAC itself was Adventist.org, which is very similar to the disputed domain name. The difference being only of the Top-Level domain.
